Terms of Service

1. Acceptance of Terms

By accessing and using EdStream LMS ("the Platform"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

These Terms constitute a legal agreement between you (or your institution) and Skyrekon Private Limited ("Skyrekon," "we," "our," or "us").

2. Description of Service

EdStream LMS is an AI-powered Learning Management System designed for educational institutions. The Platform provides:

  • • Course management and content delivery
  • • AI-powered features (AI Mentor, AI Quiz Judge, AI Summaries, Semantic Search)
  • • Student and faculty dashboards
  • • Assignment and quiz management
  • • Attendance tracking and reporting
  • • Certificate generation
  • • Other educational technology features

3. User Accounts and Responsibilities

3.1 Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 User Conduct

You agree to:

  • • Use the Platform only for lawful educational purposes
  • • Not share your account credentials with others
  • • Not attempt to gain unauthorized access to the Platform
  • • Not upload malicious code, viruses, or harmful content
  • • Respect intellectual property rights
  • • Comply with all applicable laws and regulations

4. Content and Intellectual Property

4.1 Your Content

You retain ownership of all content you upload to the Platform. By uploading content, you grant Skyrekon a license to store, process, and display your content as necessary to provide the Platform services.

4.2 Platform Intellectual Property

The Platform, including its software, design, features, and documentation, is owned by Skyrekon Private Limited and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without explicit written permission.

4.3 Codebase License

Customers who purchase the Codebase License receive full source code access and customization rights as specified in their license agreement.

5. Pricing and Payment

Pricing is based on usage (courses, students, lessons, AI queries, storage, bandwidth). All features are included in every plan. Payment terms are specified in your service agreement. Skyrekon reserves the right to modify pricing with 30 days' notice.

6. Service Availability and Support

6.1 Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance.

6.2 Support

Skyrekon provides technical support, SLA guarantees (for Enterprise customers), DevOps, hosting, security updates, and maintenance as specified in your service agreement.

7. Data Ownership and Export

You own all your data. You have full export capabilities at any time. Skyrekon provides data export tools to ensure you're never locked in. Your institution's data remains your property.

8. Limitation of Liability

To the maximum extent permitted by law, Skyrekon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Termination

Either party may terminate the service agreement with appropriate notice as specified in your contract. Upon termination, you may export your data. Skyrekon may suspend or terminate accounts that violate these Terms.

10. Changes to Terms

Skyrekon reserves the right to modify these Terms at any time. We will notify users of material changes. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.
